1. Agreement to Terms2

1.1 These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and Magicka Global, doing business as Daily Promotions (“we,” “us”), concerning your access to and use of the Daily Promotions website (https://www.dailypromotions.ca/) as well as any related applications (the “Site”).

The Site provides the following services: QR menu builder and management system for Travel Agents, Parlors, Car Washes, Restaurants, Cafés, and Bars (“Services”). By accessing the Site and/or Services, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions.

If you do not agree with these Terms and Conditions, you must discontinue use immediately. We recommend that you print a copy for future reference.

1.2 The supplemental policies set out in Section 1.7, as well as any additional terms or documents posted on the Site, are expressly incorporated by reference.

1.3 We may update these Terms and Conditions at any time. Updates will be indicated by a “Revised” date and will be effective as soon as they are accessible. Your continued use of the Site represents acceptance of any changes.

1.4 We may update or change the Site from time to time to reflect changes to our products, user needs, or business priorities.

1.5 Our Site is directed to people residing in any country. The information provided is not intended for distribution or use where such would be contrary to law or require registration in that jurisdiction.

1.6 The Site is intended for users who are at least 18 years old. If you are under 18, you may only use the Site with parental permission.

2. Acceptable Use2

2.3 By using this Site, you agree not to:

  • Systematically retrieve data to compile a database or directory without permission.

  • Make unauthorized use of the Site (e.g., collecting emails for spam, creating false accounts).

  • Circumvent or interfere with security features.

  • Mislead or defraud us or other users.

  • Upload viruses, malware, or engage in automated scraping.

  • Harass, abuse, or intimidate others.

  • Violate any laws or regulations.

3. Information You Provide2

You must provide accurate registration details and keep them updated.
You are responsible for keeping your login details secure.
If false or inaccurate information is provided, we may suspend or terminate your account.
You may link third-party accounts; by doing so, you authorize us to access relevant content in accordance with applicable terms.

4. User Content2

You may post content (“User Content”), but it must comply with our Acceptable Use Policy.
We reserve the right to remove any User Content at our discretion.
We are not responsible for User Content posted by others.

5. Our Content2

All Site content (code, design, media, etc.) is owned or licensed to us.
You are granted a limited license for personal, non-commercial use.
You may not reproduce, adapt, or exploit our content without permission.

6. Site Management2

We reserve the right to:

  • Monitor the Site for breaches.

  • Take legal action against violators.

  • Restrict or disable access.

  • Remove content that burdens our systems.

7. Modifications and Availability2

We may change or discontinue any part of the Site or Services at any time.
We do not guarantee continuous availability.
Errors and omissions may be corrected without notice.

8. Disclaimer and Limitation of Liability2

The Site is provided “as is” and “as available.”
We exclude all implied warranties to the fullest extent permitted by law.
We are not liable for indirect or consequential losses, including loss of profits, business, goodwill, or reputation.

These Terms remain effective while you use the Site or Services.

We may suspend or terminate your account at our discretion for violations.

10. General Provisions2

Communications may be electronic and are legally valid.
These Terms constitute the entire agreement between you and us.
We may assign rights and obligations to others at any time.
Canadian law applies, and disputes will be resolved exclusively in the courts of Ontario, Canada (for business users).

11. Third-Party Services – Amazon Web Services (AWS) / Amazon SES2

Use of AWS. Daily Promotions (“DP”) uses Amazon Web Services (AWS)—including Amazon Simple Email Service (SES)—to host, process, and transmit email on behalf of Clients. Your use of DP’s Service is therefore also subject to applicable AWS terms and policies in addition to these Terms.

AWS Service Terms & AUP. Clients must comply with the AWS Service Terms and the AWS Acceptable Use Policy (AUP) at all times. AWS (not DP) may suspend, throttle, or restrict sending if activity violates those policies (e.g., spam/abuse, excessive bounces or complaints), and DP may mirror such restrictions within the Service.

Verified Sending & Authentication. DP operates SES with verified domains and enforces sender authentication, including SPF, DKIM, and DMARC. Clients acknowledge that subscribers are collected and managed by the Client and that campaigns are sent by the Client to those subscribers using DP’s tools.

Anti-Spam & Sender Reputation. Clients are solely responsible for: (i) obtaining and documenting valid consent; (ii) honoring unsubscribe/opt-out requests; (iii) maintaining list hygiene; and (iv) following deliverability best practices (sender authentication, content quality, frequency controls). AWS monitors sender reputation and may place accounts under review or limit throughput to protect the ecosystem.

Deliverability & Enforcement. Inbox placement is not guaranteed. If AWS or DP detects elevated bounce/complaint rates, list abuse, or policy breaches, DP may suspend or throttle sending, require remediation (e.g., list cleanup, re-permissioning), and/or terminate access consistent with these Terms.

Privacy & Data Processing. AWS acts as DP’s sub-processor for hosting and email transmission under written terms. Data handled by AWS is subject to AWS’s privacy and security commitments; DP maintains a list of material sub-processors upon request and uses appropriate safeguards for any cross-border processing.

Security Note. DP and AWS apply appropriate technical and organizational measures (including encryption in transit and at rest and access controls). However, due to the inherent nature of electronic systems, absolute security cannot be assured, and DP is not liable for incidents beyond its reasonable control.

Incorporation by Reference. By using the Service, you agree to comply with AWS’s Service Terms and AUP in addition to these Terms.
